WAIVER AND RELEASE OF
ALL CLAIMS
Please read this form carefully and be aware that by purchasing tickets to participate in any event or activity provided by HAUNTED HOMETOWNS CORPORATION and any of its divisions (currently Historic Ghost Tours of Elgin, Historic Ghost Tours of Naperville, Historic Ghost Tours of Aurora), hereafter known as The Company, you will be waiving and releasing all claims for injuries you might sustain in the duration of the event or activity. With the purchase of your tickets you hereby recognize and acknowledge that there are certain risks—however unlikely—of physical injury to participants in The Company's events and activities, and you and your party agree to assume the full risk of any injuries, including death, damages or loss regardless of severity which you and/or your party may sustain as a result of participating in any and all events and activities connected with or associated with The Company. You agree to waive and relinquish all claims you or your party may have as a result of participation in the purchased activity and/or events, toward The Company, and its officers, agents, servants and employees; toward the property owners of the visited sites, and their officers, agents, servants and employees; and toward the City of Naperville/Elgin/Aurora and its officers, agents, servants and employees. You do hereby fully release and discharge The Company and its officers, agents, servants and employees; property owners of the visited sites and their officers, agents, servants and employees; and the City of Naperville/Elgin/Aurora and its officers, agents, servants and employees from any and all claims from injuries, including death, damage or loss which you or your party may accrue and arising out of, connected with, or in any way associated with the events and/or activities of The Company. You further agree to indemnify and hold harmless and defend The Company and its officers, agents, servants and employees; property owners of the visited sites and their officers, agents, servants and employees; and toward the City of Naperville/Elgin/Aurora and its officers, agents, servants and employees from any and all claims from injuries, including death, damages or losses sustained by you and/or your party arising out of, connected with, or in any way associated with the events and/or activities of The Company. By completing your purchase of tickets to The Company's event and/or activity, you acknowledge that you have read and fully understand the above Program Details and Waiver and Release of All Claims.
SORRY, BUT IF WE DO NOT HAVE YOUR ACCEPTANCE ON RECORD, WE CANNOT ALLOW YOU TO TAKE OUR GHOST TOURS.
WHAT THE HECK AM I SIGNING?
Basically all you're agreeing to with this Waiver is that you and all those who you buy tickets for won't sue either our ghost tours, the property owners and/or the City if you happen to step into a pothole while running from a ghost, fall into an open grave, spill hot ectoplasm onto your lap, or otherwise experience a injury and/or harm while on our ghost tours...and that includes any injury that makes you a permanent part of the ghost tour, if you catch our drift.
THIS WAIVER FORM WILL ALSO BE AVAILABLE AT THE TIME OF THE GHOST TOUR.
